Terms of Use and Service Framework
General terms for this website and the way ORYVEK presents business services. A signed or accepted quotation, statement of work or project agreement controls the specific paid engagement.
Effective 14 October 2026. Last reviewed 14 October 2026.
1. Who these terms apply to
These website terms apply to visitors and prospective clients using oryvek.com. ORYVEK services are intended primarily for businesses, organisations, founders and people acting for business or professional purposes. If mandatory consumer rights nevertheless apply to a transaction, nothing in these terms is intended to remove a right that cannot lawfully be excluded.
At the date of these terms, ORYVEK is a trading name used by Tharul Thenuwara in Sri Lanka for the services described on this website. ORYVEK is not represented here as a private limited company. The accepted quotation, invoice or project agreement identifies the contracting party, billing details and any registration information relevant to the engagement.
2. Website information is not a binding offer
Service descriptions, public package information, examples and starting prices help businesses evaluate ORYVEK. They are not a promise to perform every project at the displayed price and they do not replace a project specific quotation.
Public USD prices are primarily reference prices for international enquiries. Sri Lankan resident customers are quoted and invoiced in Sri Lankan rupees unless payment in another currency is lawfully permitted. Currency conversion, bank charges, payment provider fees, taxes, third party subscriptions, stock assets, licences, travel, hardware and unusual production expenses are included only where the quotation says so.
3. Quotations and electronic acceptance
The accepted quotation, statement of work or project agreement should identify the deliverables, exclusions, assumptions, revision allowance, client responsibilities, timeline, payment stages, third party costs, ownership position, support and any project specific conditions. If website copy conflicts with an accepted project document, the project document controls for that project.
Sri Lanka's Electronic Transactions Act, No. 19 of 2006, as amended, recognises and facilitates electronic communications and electronic contracting. ORYVEK may therefore use appropriate electronic communications and records for quotations, approvals and project administration, subject to the requirements of applicable law and the particular agreement.
4. Scope and change control
ORYVEK is responsible for the work that is actually included in the accepted scope. A request that adds pages, screens, languages, features, integrations, user roles, data migration, campaign formats, animation duration, revision cycles, new platforms or other material effort can become a change request, additional phase or separate quotation.
No use of words such as custom, bespoke, advanced or premium means unlimited future work. If the client asks for materially new work, ORYVEK can pause that part until scope, timing and price are agreed.
5. Client responsibilities
- Provide accurate project information, feedback, approvals, access and materials within a reasonable time.
- Identify legal, regulatory, accessibility, industry or security requirements that are specific to the client's business, audience or jurisdiction before they affect the build.
- Have the necessary rights to logos, photographs, video, music, copy, trademarks, data, fonts, software, testimonials and other material supplied to ORYVEK.
- Review factual claims, prices, terms, policies and regulated content before launch or publication.
- Protect account credentials and notify ORYVEK when access should be changed or removed.
6. Pricing and payments
The quotation states the payment schedule and accepted payment method. ORYVEK may delay or pause work if an agreed payment is overdue. Unless the project document says otherwise, third party costs are not assumed to be included in ORYVEK's fee merely because the project needs them.
A public starting price is not a fixed ceiling. The final quote depends on the actual scope, complexity, risk, deadline, assets, integrations, revisions, deployment requirements and support responsibility.
7. Cancellation, postponement and refunds
Project specific cancellation terms, deposits, milestone payments, postponement and refund treatment should be stated in the accepted quotation or agreement. The website does not create an automatic refund right and does not remove any mandatory cancellation or refund right that applies under law.
If a project is cancelled or paused, ORYVEK may require payment for completed work, committed production time and non cancellable third party costs to the extent permitted by the accepted agreement and applicable law. Any treatment of unused prepaid amounts depends on the project document and the work already performed.
8. Revisions and approvals
Revision rounds and approval points are defined by the scope. A revision changes the agreed work; it is not automatically a new concept, new deliverable or new direction. Approval can be recorded electronically. Work performed after approval because the client later changes direction may be treated as additional work.
9. Intellectual property and handover
Client supplied material remains the client's or its licensor's property. ORYVEK retains ownership of its pre existing methods, reusable tools, internal know how, generic code, development utilities, templates created independently of the project and other background intellectual property unless the agreement expressly transfers them.
For bespoke final deliverables created specifically for the client, the quotation should state whether ownership is transferred or a licence is granted. Where ownership transfer is promised, it normally takes effect after full payment and excludes third party components, open source software, licensed assets and ORYVEK background material. Those components remain subject to their own licences.
ORYVEK will not assume it can publish confidential client work as a portfolio case study merely because it created the work. Portfolio use should be based on public availability, consent or the applicable project agreement.
10. Open source and third party materials
Projects may use open source libraries, hosting platforms, APIs, payment services, app stores, stock assets, typefaces, analytics tools or other third party technology. Those items are governed by their own licences, availability, pricing and terms. ORYVEK cannot promise that a third party service will remain unchanged, uninterrupted or available forever.
11. Website projects and ORYVEK Care
Foundation, Growth and Signature website packages currently include 3, 6 and 12 months of ORYVEK Care respectively. Optional continuation is currently listed at $25, $40 and $60 per month for those corresponding Care levels. Continuation is not automatic and no recurring charge begins unless the client separately agrees to continue Care. The exact support tasks, response expectations, cancellation terms and exclusions are defined in the quotation or Care agreement.
Care is not ownership of the client's website and it is not unlimited development. New features, redesigns, major content production, third party subscriptions and material scope changes can be quoted separately.
12. Search, advertising and performance results
ORYVEK can provide technical SEO foundations, campaign creative, analytics setup or social media work where included. ORYVEK does not guarantee a search ranking, AI citation, advertising approval, reach, follower count, lead volume, revenue, conversion rate or other commercial result that depends on platforms, markets, audience behaviour, client operations or factors outside ORYVEK's control.
13. Software and security
ORYVEK uses reasonable engineering and security practices appropriate to the agreed project. No developer can guarantee that software will be permanently free of defects, vulnerabilities, outages or third party failures. Security testing, backup, uptime, maintenance, incident response and regulated compliance requirements are included only to the extent stated in the project scope.
14. Client data and privacy
Personal data is handled according to the Privacy Notice and the project agreement. Where ORYVEK processes personal data on a client's instructions, the parties may need additional data processing terms depending on the project, the categories of data, locations and applicable data protection laws.
15. Confidentiality
Confidentiality obligations should be stated in the project agreement or a separate confidentiality agreement where the project requires them. ORYVEK expects both sides to use reasonable care with non public business information received for the project.
16. Consumer and e commerce transparency
Sri Lanka Consumer Affairs Authority Direction No. 91 of 2023 addresses e commerce practices, including non misleading marketing, clear transaction terms, privacy information, order review, charges, cancellation and redress. This ORYVEK website is currently structured as an enquiry site rather than an online checkout. A visitor cannot complete a paid project purchase merely by submitting the contact form.
If ORYVEK later enables online ordering or payment, the purchasing flow, receipts, cancellation information, privacy disclosures and transaction records should be reviewed again before launch so that the new transaction flow reflects the requirements that apply to it.
17. Accessibility
ORYVEK aims to build this public website with responsive layouts, keyboard usable controls, meaningful structure, visible focus states, reduced motion support and practical colour contrast. WCAG 2.2 is used as a technical reference, but this statement is not a formal third party audited conformance claim.
18. Acceptable use of this website
You must not deliberately interfere with the site's operation, attempt unauthorised access, misuse contact channels, introduce malicious code, scrape personal information for unlawful purposes, impersonate another person or use ORYVEK intellectual property in a way that falsely implies endorsement or partnership.
19. Website content and trademarks
ORYVEK branding and website material that is owned by ORYVEK is protected by applicable intellectual property law. Third party names, marks, fonts, photographs, software and other licensed materials remain subject to their respective owners and licences. Viewing the site does not grant a licence to copy ORYVEK branding or imply that ORYVEK owns third party material.
20. Liability
To the maximum extent permitted by applicable law, ORYVEK is not liable for indirect, incidental, special or consequential loss arising solely from use of this informational website or from third party services linked from it. Project liability is governed primarily by the accepted project agreement.
Where a project agreement does not provide a different enforceable limit, ORYVEK's aggregate liability for claims directly arising from a paid project should not exceed the fees actually paid to ORYVEK for the affected project, except to the extent a different result is required by mandatory law. Nothing in these terms is intended to exclude liability that cannot lawfully be excluded, including liability arising from fraud or another category that applicable law makes non excludable.
21. Force majeure and events outside reasonable control
Neither side should be treated as in breach for delay caused by events genuinely outside reasonable control, such as widespread infrastructure failure, natural disaster, war, government action, major platform outage or similar event, provided the affected side communicates the problem and takes reasonable steps to reduce the impact where practical.
22. Governing law and disputes
Unless the accepted project agreement states otherwise, these website terms are governed by the laws of Sri Lanka. The parties should first try in good faith to resolve a project dispute through written discussion. Subject to mandatory law and any agreed dispute clause, the courts of Sri Lanka may have jurisdiction.
23. Changes to these terms
ORYVEK may update these website terms when services, pricing, law or website functionality changes. A later website update does not rewrite an already accepted project agreement unless both parties agree to amend that project.
